Retention and Promotion Appeals

Dear Parent/Guardian,

According to SB 1624, school districts in California are required to adopt a policy on promotion, acceleration, and retention. The law assures parents/guardians the right to appeal a decision regarding their student. It also requires the parent/guardian to bear the burden of showing why the decision of the teacher should be overruled. If you wish to appeal the promotion (regular grade promotion), acceleration (skipping a grade), or retention (repeating a grade) of your student, please state your reasons in writing in the form link below. How to Appeal (BP 6164.5)

1. Parents/Guardians may submit an appeal using this Appeal Form https://forms.office.com/r/E2mXSrdq16 within 10 school days of the determination of grade placement but no later than April 15 or for new students at the time of enrollment.
2. The district will schedule a meeting consultation with the principal, teacher, and parents/guardians within 30 school days of receiving this appeal form, but no later than on the last day of the current school year.
3. The district will notify the parent/guardian of the determination made during the consultation meeting by email correspondence.
4. The parent/guardian may appeal the determination of the team by submitting a written appeal to the Governing Board within 15 school days to Tracy Avila, at Tavila@csd.k12.ca.us
5. Within 30 days of receipt of a written appeal, the Board shall meet in closed session to decide the appeal. The Board’s decision shall be final.
6. If the final decision is unfavorable to the parent/guardian, they shall have the right to submit a written statement of objections which shall become part of the student’s record.
